APUS User System (“Service”, “APUS”, "we," "us," or "our") collects information from you in order to provide better service and a better user experience. Your privacy is a top priority to us, and this Privacy Policy explains how we collect, use, and protect your information.

  • What information we use and how we use it:

    • Read phone status and identity

      This permission allows APUS to recognize an incoming call and to switch between the User System interface and call interface.

    • Read your text messages (SMS or MMS)

      We do not save or upload your messages. We use this permission to read your text messages when you search messages in APUS search bar.

    • Take pictures and videos

      Torch is a popular feature in APUS that uses your device’s camera flashlight and requires camera permission. APUS will not take photos and videos by itself.

    • Approximate location (network-based)

      This permission is used to display apps installed by anonymous surrounding users and to recommend popular apps based on users’ location in APUS Radar. This information is untraceable.

    • Read your contacts

      APUS does not save or upload your contacts. Permission to access contact information is used when you search contacts in APUS search bar.

    • Read calendar events plus confidential information

      This information is used only in the APUS wind chime feature to remind you of your latest calendar events. We do not save or upload any of your calendar information.

    • Modify or delete the contents of your USB storage

      This permission allows users to delete APUS wallpaper stored on their SD card.

    • Read the contents of your USB storage

      This permission allows users to view APUS wallpaper stored on their SD card.

    • Set an alarm

      This permission allows users to access the device's alarm through APUS clock widget.

    • Find accounts on the devices

      APUS does not recognize or save your account information for any programs. APUS only detects whether users have a Google account linked with the device which helps us confirm the state of Google Service and provide users with appropriate application download and update methods.

    • Read Google service configuration

      This information is used to acquire advertising ID. APUS provides users with better advertising service by using such anonymous ID.

    • Change network connectivity

      This permission is used in APUS settings and notification toolbar, in order to change network connectivity.

    • Connect and disconnect from Wi-Fi

      This permission is used in APUS settings and notification toolbar in order to connect and disconnect from Wi-Fi.

    • Full network access

      This permission is used to access the device’s network for certain functions including receiving launcher update notifications or accessing app classification labels.

    • View network connections

      This permission is used in APUS settings and notification toolbar, in order to view network connections.

    • View Wi-Fi connections

      This permission is used in APUS settings and notification toolbar, in order to view Wi-Fi connections.

    • Access Bluetooth settings

      This permission is used in APUS settings, in order to turn on and off the Bluetooth.

    • Pair with Bluetooth devices

      This permission is used in APUS settings, in order to pair with Bluetooth devices.

    • Close other apps

      This permission is used in APUS Boost in order to turn off the back-end apps and make the phone run faster.

    • Retrieve running apps

      This permission is used in APUS Boost in order to view the running apps.

    • Run as startup

      APUS will run as startup to provide users with a launcher service.

    • Draw over other apps

      This permission allows the APUS FreeSwipe tab to be displayed as a floating window on other apps.

    • Control vibration

      This permission allows APUS to make the phone vibrate once after users set the device on vibrate, confirming the setting has been turned on.

    • Adjust your wallpaper size

      This permission allows users to crop APUS wallpaper to the desired size.

    • Set wallpaper

      This permission allows users to set a selected APUS image as their wallpaper.

    • Read sync settings

      This permission is used in APUS power’s save mode, and allows APUS to recognize whether sync settings are turned on or off.

    • Toggle sync on and off

      This permission is used in APUS power’s save mode, and allows APUS to synchronize with the user's sync settings.

    • Expand/collapse status bar

      This permission is used for the gesture feature of APUS User System to expand and collapse the status bar.

    • Install shortcuts

      This permission is used to install shortcuts on other launchers, so users can continue to use APUS related functions.

    • Measure app storage space

      This permission is used to acquire the amount of storage space used by an application.

    • Modify system settings

      This permission is used in APUS settings, in order to switch or adjust ringtone, vibration and brightness level of the screen.

    • Read Home settings and shortcuts

      This permission is used to acquire the user’s Home settings and shortcuts, in order to maintain user preferences.

    • Uninstall shortcuts

      This permission allows APUS to delete the shortcuts created by APUS in other Android launchers.

  • How we protect your information

    We have implemented commercially reasonable technical and organizational measures to protect your personal information from accidental loss and from loss, misuse and unauthorized access, disclosure, alteration and destruction. However, please note that although we take reasonable measures to protect your information, no app, website, Internet transmission, computer system or wireless connection is completely secure.

    We may retain third parties to perform services on our behalf and we may collaborate with third parties with respect to particular products or services. These third parties may be provided with access to the information needed to perform their functions, as long as they agree to keep the information confidential.     You do not need to provide any personal information in order to download, install and use the APUS Browser.       The only purpose using this permission is to prevent the phone from going to sleep when you are playing videos in fullscreen mode, we don't do it otherwise.

    • Draw over other apps

      We use this permission so that you can quickly search a keyword or open a website at anytime when you have just copied a keyword or URL. You can still turn it off in settings.

      Read unread number from Samsung cellphone

      We use these permissions to provide many useful features, like updating unread message number when user restarts their cellphone, displaying operation instruction on other apps, and read unread or unanswered number from Samsung branded cellphone.

  • Governing Law and Disputes Resolution

    Except to the extent that: (i) any applicable additional terms incorporated into these Terms provide differently, or (ii) the applicable laws and regulations of your jurisdiction mandate otherwise, the TOS and any dispute or claim arising out of or in connection with the TOS will be governed by the laws of the People’s Republic of China.

    Any dispute, controversy or claim (whether in contract, tort or otherwise) arising out of, relating to, or in connection with the TOS, including their existence, validity, interpretation, performance, breach or termination, will be referred to and finally resolved by arbitration administered by the China International Economic and Trade Arbitration Commission (CIETAC), and the place of arbitration shall be in Beijing. Within the valid period for the arbitration, such arbitration tribunal shall subject to the arbitration rules of the CIETAC in effect at the time of the arbitration. The award of the arbitration tribunal shall be final and binding upon the two parties.

      The only purpose using this permission is to stop cleaning operation while receiving incoming call, for preventing phone call being interfaced.

      We use these permissions to provide many useful features, like cleaning up memory, determine network status and collect basic anonymous APUS Booster+ usage data, display operation instruction, and update app white list that we recommended user not to cleanup.

UNLESS EXPRESSLY SET FORTH HEREIN, APUS FLASHLIGHT MAKES NO WARRANTY, EXPRESS OR IMPLIED, WITH RESPECT TO ANY MATTER, INCLUDING WITHOUT LIMITATION ADVERTISING AND OTHER SERVICES, AND EXPRESSLY DISCLAIMS THE IMPLIED WARRANTIES OR CONDITIONS OF NONINFRINGEMENT, MERCHANTABILITY AND FITNESS FOR ANY PARTICULAR PURPOSE. APUS FLASHLIGHT DOES NOT WARRANT THE RESULTS OF USE OF THE SERVICE, AND YOU ASSUME ALL RISK AND RESPONSIBILITY WITH RESPECT THERETO.

  • Limitation of Liability

    YOU EXPRESSLY UNDERSTAND AND AGREE THAT APUS FLASHLIGHT AND ITS AFFILIATES, SUBSIDIARIES, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATING TO THE BREACH OF THE TOS OR THE USING OF SERVICE, EVEN IF APUS FLASHLIGHT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

  • Indemnification

    You agree to indemnify and hold APUS Flashlight and its affiliates, subsidiaries, employees and agents harmless from and against any third-party claim and any related losses, costs, liabilities and expenses, including reasonable attorneys’ fees, arising out of the breach of any representations, warranties or covenants made by you.

  • Governing Law and Disputes Resolution

    Except to the extent that: (i) any applicable additional terms incorporated into these Terms provide differently, or (ii) the applicable laws and regulations of your jurisdiction mandate otherwise, the TOS and any dispute or claim arising out of or in connection with the TOS will be governed by the laws of the People’s Republic of China.

    Any dispute, controversy or claim (whether in contract, tort or otherwise) arising out of, relating to, or in connection with the TOS, including their existence, validity, interpretation, performance, breach or termination, will be referred to and finally resolved by arbitration administered by the China International Economic and Trade Arbitration Commission (CIETAC), and the place of arbitration shall be in Beijing. Within the valid period for the arbitration, such arbitration tribunal shall subject to the arbitration rules of the CIETAC in effect at the time of the arbitration. The award of the arbitration tribunal shall be final and binding upon the two parties.
